Terms of Service

Effective date: March 17, 2026

1. Agreement to Terms

By accessing or using constructs.sh, operated by Argus Technology Corporation (“the Platform”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. We may update these terms from time to time, and continued use constitutes acceptance of any changes.

2. Description of Service

constructs.sh is a platform for discovering, sharing, forking, and remixing AI agent constructs — including personas, skills, soul files, and decision frameworks. The Platform allows users to publish, browse, and install constructs for use with agentic harnesses such as Claude Code, OpenClaw, Cursor, and others.

3. Accounts

You must create an account to publish or interact with constructs. You are responsible for maintaining the security of your account credentials. You must provide accurate information and keep it current. You must be at least 13 years old to use the Platform. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Content

You retain ownership of any constructs and content you publish on the Platform. By publishing content, you grant Argus Technology Corporation a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and make available your content in connection with operating the Platform. This license includes the right to serve your content through our API and raw endpoints for agent consumption.

You represent that you have the right to publish any content you submit and that your content does not infringe on the rights of any third party.

5. Forking and Remixing

The Platform enables forking and remixing of public constructs. When you publish a construct as public, other users may fork and create derivative versions. Forked constructs maintain a link to the original. You should specify a license for your constructs if you wish to define how they may be used, modified, or distributed beyond the Platform.

6. Acceptable Use

Your use of the Platform is subject to our Acceptable Use Policy, which is incorporated into these terms by reference. Constructs that violate the Acceptable Use Policy may be removed without notice.

7. Intellectual Property

The Platform itself, including its design, code, and branding, is the property of Argus Technology Corporation. You may not copy, modify, or reverse engineer any part of the Platform. User-generated content remains the property of its respective authors.

8. Copyright and DMCA

We respect intellectual property rights and respond to notices of alleged infringement in accordance with the Digital Millennium Copyright Act. See our DMCA Policy for details on how to submit takedown requests.

9. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that constructs published on the Platform are safe, accurate, functional, or suitable for any particular purpose. You use constructs at your own risk. Constructs are executable agent configurations and may perform actions on your behalf — review any construct thoroughly before use.

10. Limitation of Liability

To the maximum extent permitted by law, Argus Technology Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the Platform or any constructs obtained through it. In no event shall our total liability exceed the greater of $100 USD or the total fees paid by you to us in the twelve months preceding the claim.

11. Agent Execution Risks

Constructs are executable agent configurations that may cause AI agents to perform real actions on your behalf, including but not limited to modifying files, executing code, making API calls, and interacting with third-party services. Argus Technology Corporation does not review, audit, or verify constructs for safety or correctness. You are solely responsible for reviewing any construct before use and for all actions taken by an agent configured with a construct obtained through the Platform. Some actions performed by agents may be irreversible.

12. Indemnification

You agree to indemnify, defend, and hold harmless Argus Technology Corporation, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your content, your violation of these terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Platform at any time for any reason, including violation of these terms. You may delete your account at any time. Upon termination, your right to use the Platform ceases, but provisions that by their nature should survive will remain in effect.

14. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

15. Export Controls

You may not use the Platform if you are located in, or a national or resident of, any country subject to U.S. sanctions, or if you are on any U.S. government restricted persons list. You agree to comply with all applicable export control and sanctions laws.

16. General Provisions

If any provision of these terms is held to be unenforceable, the remaining provisions will continue in full force and effect. These terms, together with the Privacy Policy, Acceptable Use Policy, and any additional terms for specific features, constitute the entire agreement between you and Argus Technology Corporation. Our failure to enforce any provision shall not constitute a waiver of that provision. Neither party may assign these terms without the other's consent, except that Argus Technology Corporation may assign in connection with a merger, acquisition, or sale of assets. Neither party shall be liable for delays or failures caused by events beyond reasonable control.
